MCI Increase Granted for Elevator Modernization

The DRA approved landlord's MCI rent increase application based on elevator modernization. Tenants appealed and lost. They claimed that a prior MCI rent increase was granted for an elevator upgrade within the last 25 years and that the modernization was needed due to landlord's failure to maintain the elevators. Tenants also complained that the cost of a handicap lift elevator served only the commercial space in the building and was improperly included in the MCI cost. The DHCR pointed out that tenant didn't raise these claims before the DRA, so they couldn't be considered on appeal.
