MCI Increase Granted for Backflow Prevention Device

Landlord applied for MCI rent hikes based on installation of a backflow prevention device. The DRA ruled for landlord and increased tenants' rents. Two tenants appealed and lost. Tenants claimed that landlord didn't submit a cost breakdown and that they weren't given a proper opportunity to respond to the MCI application. The DHCR noted that landlord submitted copies of a contract and cancelled checks proving that the work was done. And tenants were granted several extensions, receiving ample time to respond to the MCI application. Since they didn't raise their claim about the cost breakdown before the DRA, they couldn't do so for the first time on appeal.
