Loft Unit Covered

Landlord sued to evict commercial loft tenant whose lease was over. Tenant claimed that she was rent stabilized. The building was an interim multiple dwelling covered by the Loft Law. At the trial, tenant showed that landlord knew for many years that she lived in the loft, despite the commercial lease. Landlord's second lease with tenant even omitted language barring residential use. So tenant was covered under rent stabilization and entitled to a renewal lease.
