Lobby Window Defects Not Minor

Tenant complained of a reduction in building-wide services. He said that the building lobby window was defective. The DRA ruled for tenant and reduced his rent. Landlord appealed, claiming that the lobby window condition was minor and didn't warrant a rent reduction. The DHCR ruled against landlord. DHCR inspection showed that the lobby window was inoperable, that the lower window sash was off track and loose inside the frame. This wasn't a minor condition. Landlord was required to keep all windows at the building in good repair.
