Lobby Improvements Don't Qualify

Landlord applied for MCI rent hikes based on building lobby renovation work. The DRA ruled against landlord. Landlord appealed and lost. Lobby improvements don't qualify as an MCI unless they are done in connection with an MCI such as new mailboxes or a new intercom. Landlord didn't install any MCI with the lobby renovation work here. And even if special artistic effects were created with the painting of walls and ceilings, the work is still considered ordinary maintenance.
