Landlord's Vacation No Excuse for Sidewalk Debris

DOS issued a violation notice to landlord for failing to clean 18 inches into the street in front of her building. Landlord said that she was on vacation during the week that the violation was placed. She said that there was no debris either on the day she left or the day she returned. The ALJ fined landlord $100. Landlord appealed and lost. Being away was no excuse. Landlord must make reasonable efforts on a regular basis to remove litter from in front of her building. If she was away, she must find someone else to keep the area clean in her absence.
