Landlord's Rent Demand Didn't Clearly or Properly Set Forth Amounts Due

LVT Number: #33482

Landlord sued to evict tenant for nonpayment of rent. The court granted tenant's request to dismiss the case based on a defective rent demand. The rent demand didn't fairly tell tenant of the periods of rent allegedly due and in what amounts, and potentially prejudiced tenant's ability to respond. The court also held that by simply attaching a rider to the rent demand that included contradictory amounts and non-collectible fees and charges as well as additional irrelevant information, landlord didn't comply with its obligation to provide a proper rent demand.
