Landlord's Plans Not Produced at Inspection

DOB issued a violation notice to landlord for not having approved plans available for inspection at a construction site. When the inspector appeared, four men were performing alteration work on the second floor of landlord's two-story house. Landlord pointed out that the plans were on the second floor, but that the contractor had stepped out to do some errands at the time of inspection. The ALJ ruled for landlord and dismissed the violation.

When the inspector appeared, four men were performing alteration work on the second floor of landlord's two-story house. Landlord pointed out that the plans were on the second floor, but that the contractor had stepped out to do some errands at the time of inspection. The ALJ ruled for landlord and dismissed the violation. DOB appealed, arguing that Building Code Section 27-146 requires that approved plans must be kept at the building and be "open at all times to inspection" by DOB until the work is completed. ECB ruled for DOB and fined landlord $130. The fact that the plans were on site was no defense since they couldn't be produced for the inspector.
