Landlord's 2010 Fuel Cost Adjustments Suspended

The DRA suspended landlord's fuel cost adjustments for rent-controlled tenants for 2010 based on landlord's failure to file a timely 2010 report of fuel price decrease. Landlord appealed and lost. Landlord claimed that it was waiting for the DHCR's decision on a PAR it filed concerning the DRA's decision on 2009 fuel cost adjustments. But the fact that the DHCR hadn't yet decided landlord's PAR of the 2009 fuel cost adjustment didn't excuse landlord from filing a timely 2010 report.
