Landlord Switched Stoves from Gas to Electric Service

Tenants complained to the DHCR of a reduction in building-wide services. They claimed that landlord improperly eliminated natural gas service to the building. The DRA ruled for tenants and reduced their rents. Landlord appealed. Landlord had replaced tenants’ gas stoves with electric stoves before obtaining permission to substitute this service from the DHCR. Landlord’s application for permission to convert from gas to electric stoves presently was pending before the DHCR. Landlord could apply for rent restoration if that application was granted.
