Landlord Submitted Incomplete Fuel Cost Report

Tenant challenged landlord's 1993 fuel cost report, claiming that she received an incomplete report and that the rent increase landlord asked for was excessive. Landlord claimed it had sent tenant a full copy of the report. The DRA ruled against tenant, and she appealed. The DHCR ruled for tenant. Review of the DRA's records showed that the copy of the report filed with the DRA was also incomplete. The DHCR revoked the fuel passalong and directed a refund to tenant.
