Landlord Submitted Date-Stamped Copy of Form

The DRA suspended all fuel cost adjustments at landlord's building for the years 1993 and 1994. The DRA found that landlord had previously gotten allowable fuel cost adjustments and didn't file reports of fuel price decreases during 1993 and 1994 on time. Landlord appealed, claiming that it filed the required fuel cost reports on time and delivered the reports to tenants and credited them with the reported fuel cost decreases. The DHCR ruled for landlord. Landlord proved that it had filed the reports by submitting copies that were date-stamped by the DHCR.
