Landlord Submitted Comparability Data

Tenant filed a fair market rent appeal. The DRA ruled for tenant and reduced his rent. Landlord appealed, claiming that the DRA didn't consider comparability data it submitted. The DHCR ruled for landlord. The DRA did receive an answer from landlord with a completed Schedule A form from the pre-1984 Fair Market Package of answer forms sent to landlord by the agency. Landlord submitted rental data for the complete ''K'' line of apartments. The DHCR recalculated tenant's first rent, using the comparable rent submitted by landlord.
