Landlord Showed Burner Used #2 Oil

The Fire Department issued a violation notice to landlord for violating Rule 18 by not providing a certificate of approval from DOB to install a burner that used #4 oil with gas. Landlord argued that it didn't use #4 oil on the violation date. The ALJ ruled against landlord and imposed a $300 fine. Landlord appealed and submitted a DEP work permit for installation of a boiler which burned #2 oil and gas sometime prior to the violation date. ECB ruled for landlord and revoked the fine. The Fire Department showed no proof to the contrary.
