Landlord Seeks Deemed Renewal Increases for Tenant’s Parking Lease

Landlord asked the DHCR to reset the legal rent for tenant’s parking space. Tenant paid $41 per month and had refused to sign renewal leases for the parking space with prior landlord since 1997. The DHCR ruled against landlord, finding that tenant had paid $41 per month since 2003 and that there was no written agreement for the parking space. Landlord filed an Article 78 appeal. The court ruled for landlord and sent the case back to the DHCR for reconsideration. The DHCR then directed landlord to submit proof that parking renewal leases were sent to tenant.
