Tenants complained of a reduction in building-wide services. The DRA ruled for tenants, finding that the brownstone building's facade was worn. Landlord later filed an application to restore rents based on the restoration of services. The DRA ruled against landlord, who appealed and won. The DRA had denied landlord's application to restore rent based on an inspector's report stating that the facade was "stained." But the rent reduction order stated only that the facade was "worn." And landlord had replaced the brick face two years earlier, as part of a complete renovation of the building. This work cured the defective condition. Rents were restored retroactively to Sept. 1, 2013.
