Landlord sued to evict tenant for nonpayment of rent. The court ruled for landlord in part. Landlord was awarded $326,000 in back rent. Tenant got a 5 percent rent abatement for five years because of inadequate and unreliable elevator service. Tenant also got a 50 percent rent abatement for two weeks because of buckling floors. Landlord appealed. The appeals court ruled for landlord in part. Because landlord promptly made any required repairs to the floors, that part of the rent abatement was revoked.
