Landlord Removed Laundry Facilities

Tenant complained of a reduction in services based on landlord's removal of laundry facilities. The DRA ruled for tenants, and landlord appealed. Landlord claimed that laundry services were provided by a former building super as his own business. Since the super was dismissed, he no longer provided laundry service, and landlord wasn't obligated to continue this service. The DHCR ruled against landlord. From 1994 until 2000, tenant had use of laundry equipment, which landlord claimed was installed by the building super without authorization.

The equipment was still in the basement when the DHCR inspected it in response to tenant's complaint. The laundry facilities were provided to tenant since she moved into the building by landlord or landlord's agent and were a required ancillary service.
