Landlord Put Recyclables in Cardboard Boxes

DOS issued a violation notice to landlord for using an improper curbside container. The notice stated that plastic bottles had been placed out for collection in seven cardboard boxes that weren't designated for plastic recyclables. Landlord claimed that these items were placed in front of his building by an outsider. But landlord didn't live in the building and the ALJ didn't find his claim credible. Landlord was fined $25. Landlord appealed and lost. Landlord failed to prove that no one at the building placed the improper receptacles out for collection.
