Landlord Proved No Boiler on Fifth Floor

DOB issued a violation notice to landlord for performing work without a permit. DOB claimed that landlord had installed a gas-fire steam boiler in an improperly enclosed space on the fifth floor of the building. Landlord argued that there was no boiler on the fifth floor. The ALJ believed landlord and dismissed the violation. DOB appealed and lost. DOB's inspector had no specific recollection of the violation and couldn't testify that it existed.
