Landlord Proved Cash Payments Made to Contractor

Landlord applied for MCI rent increases based on the installation of a new roof. The DRA ruled for landlord in part. The DRA disallowed any increase for the portion of the claimed cost that landlord didn't submit canceled checks for. Landlord appealed, claiming that he made cash payments for part of the cost of the MCI. The DHCR ruled for landlord. Landlord submitted sworn statements from his contractor saying that landlord had made two cash payments as a down payment on the work before it started.
