Landlord Overcharged Rent-Stabilized Tenant on Garage Rent

Rent-stabilized tenant complained to the DHCR of rent overcharge. He claimed that landlord increased his parking space rent in excess of the legal rent when tenant renewed his lease. The DHCR ruled for tenant. Landlord appealed and lost. The court and appeals court ruled that the DHCR’s decision wasn’t affected by any error of law, wasn’t arbitrary and capricious, and wasn’t an abuse of discretion.
