Landlord Not Required to Make Additional Repairs
LVT Number: 14709
Tenant sued landlord to get apartment repairs. The court ordered landlord to correct electrical violations relating to wall switches and fixtures and to fix the exhaust system in the bathroom. Tenant appealed, claiming that landlord should also have been ordered to upgrade the wiring for an air conditioner. The appeals court ruled against tenant. A DOB representative had testified at the trial that the electrical system for the building was up to code. Operation of an air conditioner would require the installation of a dedicated line. But under the building code, landlord wasn't required to install such a line.
