Landlord Not Required to List Frozen Rent on Renewal Lease Offer

Rent-stabilized tenant complained of rent overcharge and improper lease renewal based on a rent reduction order that landlord didn’t comply with. The DRO ruled for tenant and found an overcharge of $2,945, including interest. Landlord appealed and lost. The DRO properly credited landlord for rent underpayments by tenant and ordered a refund of $702. And with respect to the lease violation complaint, the DRA determined that landlord had correctly applied Rent Guidelines Board increases to tenant’s preferential rent on renewal leases between 2010 and 2015. While the collectible rent remained frozen due to the pending rent reduction order, landlord wasn’t required to list the frozen rent on tenant’s renewal leases.
