Landlord Need Not Offer Lease for Parking Space
LVT Number: 10247
(Decision submitted by Anthony J. Cornicello of the Manhattan law firm of Fromme, Fromme & Schwartz, attorneys for the landlord.) Landlord sued to evict tenant for nonpayment of rent. The court ruled for landlord, and tenant appealed. Tenant claimed that landlord didn't offer him a lease for a parking space connected to the apartment. The appeals court ruled against tenant. Landlord made a parking space available for tenant. No specific ''lease'' was required; a parking license agreement was sufficient.
