Landlord Must Restore Wall and Fixtures of Loft Space
LVT Number: 10846
Landlord sued to evict loft tenant, claiming he had no right to the unit. Tenant claimed he was seeking Loft Law protection in a proceeding before the Loft Board. Tenant also claimed that landlord illegally removed a wall and fixtures which had separated tenant's space from that of another tenant on the same floor who had moved out. The court ruled for tenant. Tenant had a right to occupy the space under a lease agreement with landlord. Landlord must restore the wall and fixtures and permit tenant to move back into the loft.
