Landlord Must Deliver Court Papers to Tenant at Nursing Home
LVT Number: 14226
Landlord sued to evict 90-year-old tenant. Tenant was currently residing in a nursing home and not in her apartment. Landlord asked the court to rule in its favor because tenant didn't appear in court. The court ruled against landlord. Landlord delivered the court papers only to tenant's apartment. Under the RPAPL, he was also required to deliver the court papers to tenant at the nursing home. So he wasn't entitled to a default judgment.
