Landlord Must Add Tenant's Spouse to Renewal Lease
LVT Number: #29759
Rent-stabilized tenant complained that landlord wouldn't properly renew her lease. The DRA ruled for tenant and ordered landlord to add tenant's husband's name to the renewal lease. Landlord appealed and lost. Landlord asked permission to increase tenant's security deposit, requested that there be no smoking in the apartment, and asked that the barking of tenants' two dogs be controlled. Landlord didn't dispute the DRA's order to renew tenant's lease and add her husband's name. Landlord can request and hold a security deposit only equal to the legal regulated rent. Issues regarding smoking and tenants' dogs weren't raised before the DRA and couldn't be raised in landlord's PAR.
