Landlord Must Add Tenant's Husband to Lease

Rent-stabilized tenant complained that landlord refused to add her husband's name to her renewal lease. The DRA ruled for tenant and ordered landlord to add the husband's name to the renewal lease that was current on the date the order was issued. Landlord appealed and lost. Landlord argued that it proved the husband didn't live in the apartment and therefore need not be added to tenant's renewal lease. Landlord submitted sworn statements from two building employees, each stating that the husband didn't live in the building.

Landlord argued that it proved the husband didn't live in the apartment and therefore need not be added to tenant's renewal lease. Landlord submitted sworn statements from two building employees, each stating that the husband didn't live in the building. But tenant submitted copies of the husband's driver's license, notice from the DMV, income tax returns, Social Security statement, bank statements, and mailings from AARP and Costco, all showing the husband lived at the apartment during the time in question. Tenant showed that the husband lived in her apartment as his primary residence and therefore was entitled to have his name added to her renewal lease.
