Landlord Must Accept Section 8 Vouchers

Forty-seven tenants sued landlord after landlord refused to accept Section 8 rent subsidy vouchers from them. The court ruled for tenants, finding that landlords must accept federal rent vouchers from existing as well as new tenants. Landlord appealed and lost. Local Law 10 of 2008 added an antidiscrimination provision to New York City’s Human Rights Law requiring landlords to accept the vouchers from “any person.” A long-standing provision of the city’s tax abatement program also requires landlords who receive J-51 benefits to accept vouchers from tenants.
