Landlord Mixed Other Trash with Recyclables

DOS issued a violation notice to landlord for leaving other trash in a recycling container left out for collection. Landlord claimed that the recyclables had been collected before the time that the violation notice was issued, so the notice was incorrect. The ALJ ruled against landlord and fined him $100. Landlord appealed and lost. There was insufficient proof of his claim, and landlord didn't provide any information as to what procedures he used to ensure proper recycling procedures at the building.
