Landlord Mistakenly Checked Off Wrong Box on Form

Landlord applied for MCI rent increases based on a number of improvements. The DRA granted landlord's application for some of the improvements, and tenants appealed. They claimed that landlord purposely indicated on its application that tenants had agreed to the installations when in fact they hadn't. The DHCR dismissed tenants' PAR. There was no proof that landlord intended to commit fraud, and landlord claimed that it checked the wrong box on the MCI application form by accident.

In any event, the error didn't matter because landlord doesn't need the tenant's consent to get an MCI rent increase.
