Landlord Made Reasonable Efforts to Keep Sidewalk Clean

DOS issued violation notices to landlord for having a dirty sidewalk area in front of its building. Landlord testified at a hearing that the building had five stories and 32 apartments. Landlord said its full-time porter swept the sidewalk and curb five times a day. The ALJ ruled against landlord and fined it $150. Landlord appealed and won. Landlord's testimony was credible. The ALJ also erroneously stated in his decision that the building contained 53 apartments. The violations were dismissed, and the fines revoked.
