Landlord Got Incomplete Copy of Tenant's Complaint

Tenants complained of a decrease in building-wide services. Landlord answered that each of the conditions in the complaint had been corrected. An inspection showed that some defective conditions still existed. The DRA ruled for tenants, and landlord appealed. Landlord had gotten a tenant complaint form from the DRA listing defective conditions and one added page of more defective conditions. Tenants had in fact submitted to the DRA two added pages to the complaint form.

Since landlord addressed each of the conditions it claimed to get notice of, it was believable that landlord never got the second added page of the complaint. The DHCR revoked the rent cuts and sent the case back to give landlord the chance to answer the full complaint.
