Landlord Gets Rent Hike for Increased Operating Costs

Mt. Vernon landlord applied for a 9.5 percent increase to tenant's rent-controlled rent by filing a 60-day notice of maximum rent adjustment with the DHCR. The DRA denied any increase because tenant's $570 rent was more than the average rent for comparable ETPA apartments in the building. Landlord appealed and won, claiming that the DRA miscalculated. The actual average rent for the comparable apartments was $615. So landlord could increase tenant's rent to at least this amount.
