Landlord Fined for Unsealed Mattress in Front of Building

DOS issued a violation notice to landlord for leaving an unsecured mattress at curbside for collection. Landlord claimed that he found the mattress in front of his building two days before collection day, called 311, and was advised to bring the mattress inside until collection day. Landlord said the 311 operator told him he didn't have to seal the mattress if it didn't come from his building. The ALJ ruled against landlord and fined him $100. Landlord appealed and lost. Mattresses must be sealed before being placed outside for collection by DOS.
