Landlord Fined $47,400 for Illegal Building Alterations

DOB issued a violation notice to landlord for altering a building for occupancy by more than the legally approved number of families. Landlord claimed that it received insufficient notice that daily penalties would apply. The ALJ ruled against landlord and fined it $47,400. Landlord appealed and lost. The notice of daily penalties was included in the violation notice. Landlord offered no proof to the ALJ that the violation had been corrected, so the ALJ correctly imposed daily penalties of $1,000 per day for the maximum 45-day period authorized by Admin. Code Section 28-202.1.
