Landlord Fined $1,250 for Building Facade Violation

DOB issued a violation notice to landlord for failing to maintain a building facade. DOB's inspector observed a crack on a parapet at roof level with a steel beam bearing inside the parapet. This was the structural support for the roof water tank for the building. At a hearing, landlord reported that it had been waiting for its architect to file a Facade Inspections Safety Program (FISP) report. Landlord asked DOB to agree that repairs could be completed by February 2022, when the FISP report had to be filed.

Since nothing had been corrected by the hearing date, the ALJ fined landlord $1,250. Landlord appealed and lost. The ALJ imposed the proper penalty since the violation wasn't cured by the time of the initial hearing date. And ECB had no discretion or authority to reduce or eliminate penalties.
