Landlord Explained Delay in Project Completion

Landlord applied for MCI rent hikes based on the installation of new windows and pointing work. The DRA denied the increase for pointing because the work had been done on a piecemeal basis. Landlord appealed and submitted a statement from its contractor explaining that the work was delayed because the contractor was involved in other projects at the same time. The work was started in 1995, delayed in 1996, and finished in 1997. The DHCR ruled for landlord. The pointing work was done under a single contract and was meant to be part of one project.
