Landlord Entitled to Increase for Actual Cost of Work

Landlord applied for MCI rent increases based on installation of a new roof. The DRA ruled for landlord but ordered a rent increase based on a $10,000 portion of the cost of the work allowed by the city's J-51 tax benefit program for such work. Landlord appealed, claiming it was entitled to rent increases based on the full $19,000 cost of the roof installation. The DHCR ruled for landlord. Under applicable rent-control and rent-stabilization regulations, landlord could get MCI rent increases based on the actual cost of the work.
