Landlord Disregarded Time Frame for Occupants to Quit Premises

Landlord, which became the building owner under a Referee's Deed, sue to evict occupants of a first-floor apartment in the building after serving a 10-day notice to quit. Landlord claimed that none of the occupants were believed to be bona fide tenants as defined under the Protect Tenant at Foreclosure Act (PFTA) and RPAPL Section 1305. The court granted occupants' request to dismiss the case, finding that landlord's predicate notice had been rendered null and void because landlord disregarded the time frame stated in the notice.
