Landlord Discontinued Storage Service

Rent-stabilized tenants complained of a reduction in building-wide services based on a decrease in basement storage space. Tenants stated that landlord discontinued the open storage space they had used for 40 years and began selling storage bins and boxes to co-op shareholder tenants at the building. The DRA ruled for tenants and reduced their rents. Landlord appealed and lost. It was improper for landlord to offer the storage units only to nonstabilized tenants after removing the service previously provided to tenants.

And New York's General Business Law Section 352-eeee requires equal treatment of purchasing and nonpurchasing tenants in co-op and condo buildings.
