Landlord Didn't Submit Proof of Installation of BPD

DEP issued a violation notice to landlord for failing to install a backflow prevention device (BPD) at its building. Landlord claimed that it had installed the device in January 2015 and that its plumber or engineer immediately mailed reports to DEP. The ALJ dismissed the complaint. DEP appealed and won. DEP didn’t receive the initial test reports until February 2016, a year after the device was tested. There was no proof that this report had been submitted in 2015 as claimed by landlord. Landlord was fined $700.
