Landlord Didn't Remove Snow on Time

The DOS issued landlord a violation notice at 11:43 a.m. for not removing snow from the sidewalk. The snow had stopped falling at 3:00 a.m. the night before. The ALJ fined landlord $50, and she appealed. Landlord claimed that she'd applied salt the night before, and didn't know how quickly she had to clear the sidewalk. Landlord also claimed that ill health prevented her from doing the work herself, and that the person she hired had arrived shortly after the inspector issued the violation. The ECB upheld the fine.

Landlord also claimed that ill health prevented her from doing the work herself, and that the person she hired had arrived shortly after the inspector issued the violation. The ECB upheld the fine. Landlord must clear the sidewalk within four hours after the snow stops, excluding the hours between 9:00 p.m. and 7:00 a.m. And if landlord can't do the work herself, she must arrange for it to be done on time by someone else.
