Landlord Didn't Place Copy of Application in On-Site Office

Landlord applied for MCI rent hikes, based on the installation of new windows. The DRA ruled for landlord, and tenants appealed. Tenants claimed that landlord didn't make the complete MCI application available for their examination, in their building's rental office, while the application was pending. Tenants got complete copies of landlord's application from the DHCR only after the rent increases had been granted. Landlord had made a copy of the application available at its Manhattan office, but not at the building itself, which was in Yonkers.

Tenants had to be given the opportunity to respond to the MCI application before getting any rent increase.
