Landlord Didn't Maintain Elevator

DOB issued a violation notice to landlord for failure to maintain an elevator at the building. The elevator was out of service at the time of inspection and was the only elevator in the six-story building. The ALJ fined landlord $1,000. Landlord appealed and lost. Landlord claimed that the violation was a Class 2 violation, not a Class 1 violation. But landlord didn't raise this before the ALJ and couldn't do so for the first time on appeal.
