Landlord Didn't Keep Area in Front of Building Clean

DOS issued two notices of violation to landlord after its inspector saw large accumulations of scattered magazines, napkins, paper, tissues, wrappers, bottles, cans, cups, and newspapers in the front yard of the building behind a gate. Landlord claimed that pedestrians bought food from a vendor on the block and dropped garbage in front of its building. Landlord blamed full DOS trash baskets. The ALJ ruled against landlord and fined it $200. Landlord appealed and lost. For the first time, landlord claimed that its tenant and employees clean the premises. But landlord failed to show that it made reasonable efforts on a daily basis to keep the area in front of its building clean.
