Landlord Didn't Certify Correction of Violation on Time

The Fire Department issued a violation notice to landlord for not maintaining a fuel oil tank and for not submitting, within a given time limit, a certificate from a licensed tank installer stating that the fuel oil tank was leak-free. Landlord argued that the last date to file the certificate was Jan. 1, 1993. This was a holiday. When it tried to file the certificate on the next business day, the Fire Department refused to accept it and told landlord to attend a hearing. The ALJ ruled against landlord and fined it $150. Landlord appealed. ECB ruled against landlord. Landlord's proof that the leaks were fixed consisted of a letter from its fuel oil company dated Feb. 8, 1993, well after the Jan. 1 deadline.
