Landlord Corrected DOB Elevator Violation

Tenants complained of a reduction in building-wide services. An inspection on Oct. 14, 1993, showed the elevator wasn't working. The DRA also considered a DOB elevator violation dated Aug. 18, 1993. The DRA ruled for tenants in March 1994 and reduced their rents. Landlord appealed. DOB had reinspected the elevator on Dec. 6, 1993, and found that the violation had been corrected. Landlord had no notice that the DRA was considering DOB records and no opportunity to submit proof of correction of the violation. The DHCR ruled for landlord and revoked the rent reductions.
