Landlord Collected Overcharge from Tenant with DRIE

SRO tenant filed a rent overcharge complaint, claiming that landlord charged more than the rent permitted by hotel stabilization guidelines. The DRA ruled for tenant, and ordered a rent refund with triple damages. Because tenant had been receiving Disability Rent Increase Exemption Program (DRIE) benefits since 2008, his monthly rent should have been frozen at $704. Landlord appealed, claiming that tenant wasn't overcharged and that he owed back rent. The DHCR ruled against landlord. Landlord submitted no evidence to the DRA supporting its claim.
